Pre council to order, good to see everybody always and. 00:00:00
Thank you for the information last night. 00:00:07
Oh. 00:00:09
You. 00:00:12
They doesn't end at 5:00. 00:00:13
No, I appreciate that. 00:00:15
So is there a motion we approve the Minutes? 00:00:18
Motion second. All in favor. Say aye and it's approved. OK, Mr. Mills, there you are. 00:00:21
I'll start early for the Chattanooga. 00:00:33
We all got that covered. OK, Good afternoon, counselor. Mayor, We have two applicants today. 00:00:36
The first one for AP N LLC DBA is Ave. Pub N Bank. 00:00:43
They're going at 1491 N Bank Parkway. They're applying for a restaurant retail liquor license. 00:00:50
Bar in District 3. 00:00:56
He is a great restaurant. 00:00:58
It's right over about Urban Cookhouse. 00:01:04
Yes, Sir. Oh, is it going to be in the same It's just being built right beside the North Bank office park, right there with Urban 00:01:09
Food Council. 00:01:13
OK, and my second applicant is. 00:01:19
Pop Strokes, Tuscaloosa LLC, DJ Pop Stroke. 00:01:22
For special retail more than 30 days and 680 Harper Lee Drive. 00:01:28
Why special ret? 00:01:35
More than 30 days went off restaurant. They'll be able to serve alcohol out on the premises, around the whole entire premises, 00:01:37
inside of the restaurant area itself. So they don't have a licensed premises yet. But the ABC, because it's not completely they 00:01:43
have been able to take the final pictures, so the ABC recommend they apply for special retail more than 30 days. 00:01:49
OK. I'm not sure I'll follow so they can. 00:01:58
One more slower they'll be able to have the alcohol. Not necessarily inside the restaurant, but they can have it out on the golf 00:02:02
course, the Putt Putt golf course. 00:02:05
Tony, Will they? Likely, when they get the restaurant finished, they'll come back and apply for the restaurant then? 00:02:14
So there's nothing they could do with a restaurant license? 00:02:22
That they can't do with a special retail for more than 30 days. Well your restaurant license is going to be covered at particular 00:02:27
premise inside and maybe outside of the patio area. This one will cover the whole area that the restaurant itself and along the 00:02:33
course the beer garden. So you can say hold my beer and watch this. 00:02:39
Watch me putt. Famous last words and I guess. 00:02:46
They're coming tonight, correct. Yes, Sir. 00:02:52
That's that's all I have. 00:02:56
Yeah, yeah, I remind everybody. Thank you. Reminder 1-2 if you're. 00:03:01
For employment, they are very active, go to pop stroke website and they're taking applications for jobs of all kinds. 00:03:05
Assistant managers. 00:03:15
Just every everything. 00:03:18
As well as Burlington, they're still taking applications. 00:03:21
All right. 00:03:27
We got two annexations for you guys. First one is 1.33 acres at 15560 Kevin Cove. 00:03:32
So this is. 00:03:41
A house on the lake. They want to come in for City Schools. It's close to tears, Patton. 00:03:43
Off of 43 close to that bridge. 00:03:49
So they are just coming in for City Schools. It was unanimously recommended for approval with August Planning Commission. 00:03:54
And it gets garbage and that stuff, no. So ESD has stated that they are outside their service boundary. 00:04:01
And then we have one more annexation for you guys. So this one is 40.5 acres at 4500 Cypress Creek Ave. East. So this is South of 00:04:09
Skyland Blvd. 00:04:14
Kind of catty corner to If you look on the map, the top right corner is the DMV, the State troopers office. 00:04:20
So it's just South of that on a pretty vacant piece of land I think there's a house on. 00:04:28
On the land. 00:04:34
And this will be. 00:04:36
As part of a planned unit development that you guys will hear in a couple of weeks. 00:04:38
But for now, they're petitioning to annex into the city so that they can then pursue the plan unit development. 00:04:44
Miss was unanimously recommended recommended for. 00:04:51
At the October. 00:04:54
Again, we're going to go way more in depth on this in the future, but this is what they're going to be proposing to you guys with 00:04:56
that plan unit development. Can you go back to the aerial photo for just? 00:05:01
So that's the state trooper office. 00:05:09
Just off the. 00:05:13
Upper right corner, Yes. 00:05:16
Place behind the whole automax. 00:05:18
Auto Saint Luke's Church. 00:05:22
And they will be getting garbage. It is a primary expansion area, as you can see in that aerial. It's basically an island within 00:05:31
the city limits. 00:05:36
It's a good thing that they're coming in and they will be providing garbage or we will be providing garbage. 00:05:41
And that's all I've got for you guys tonight. And again, of course, those can be adopted by unanimous consent tonight. 00:05:47
Following, I have to ask this question about people coming into the city to go to City Schools. Yes, Sir. They've signed the form 00:05:54
that says they understand that this is kind of like Hotel California. Yes Sir. Right. And they are from California, so they're 00:05:59
familiar with you. Check out. You can never leave. Check in. 00:06:05
Because I know that was a controversial thing first. 00:06:13
Definitely, yeah, they're they're aware. 00:06:16
OK. Thank you. 00:06:21
Mathematics. Yes. Tonight. I will not be a council meeting. I'll be leaving around 5:00 for a veteran's day program, but very 00:06:22
preferential. Students have a fourth grader close to my heart. They'll be participating in it. I will be meeting you back tonight 00:06:28
later for the announcement. So I will see you tonight. 00:06:34
Afterwards, and I know miss days work should be working with you and providing transportation for you. 00:06:41
It made a lot of sense. So excited to have him. I hope he sees it as a good thing and not a bad thing. 00:07:25
Don't treat me that way. 00:07:33
He's taking his sales. 00:07:37
Spot on. 00:07:40
On the Planning Zoning Commission. Oh, OK and. 00:07:42
It was funny this morning when he came to meet with me, you know, he, I guess he saw me and Ashley there. He wasn't as worried. I 00:07:46
said good thing it wasn't me and Lashonda, you were. That's when you have to worry a little bit. But I'm excited about John. I'm 00:07:53
probably going to join our Planning Commission, so just wanted to make you aware of that. 00:07:59
That's. 00:08:06
OK. Thank you, Mayor. 00:08:08
OK, SO2 quick things. The 1st is the Tuscaloosa Metro Animal Shelters Advisory Committee. Mr. Tyner, your term has expired. 00:08:18
If you would like to be reappointed, we can have an ordinance on the 21st to reappoint you. 00:08:28
I want to be reappointed. Thank you. 00:08:33
If it wasn't for the animals, I would not want to be, you know, anymore. 00:08:37
And then the last thing I have is I have a new assistant city clerk. Miss Haley Abbott is joining us. 00:08:43
Introducing yourself to everyone. 00:08:50
Thank you very much. My name is Haley Abbott. I'm. 00:08:56
We finally got one of y'all over here. 00:09:01
That's all I have. I'm kidding. Northport. 00:09:11
Oh. 00:09:24
Scott, yes, Sir. Good afternoon, council. I am about midway down on page two, we're on page 13, you'll be authorizing the purchase 00:09:29
of equipment from client trailers. It's a total of $14,975 and comes from purchasing. 00:09:36
On page 14, you'll be authorizing the purchase of equipment from Pro Trainer. This is a total of $61,730 is for two ESD recycling 00:09:43
trailers, and the game comes from purchasing. 00:09:49
On page 15 you'll be authorizing the purchase of equipment from Unruh Fire Inc. This is a total of $66,678.21. This comes from 00:09:56
purchasing is for a TFRR skid unit. I believe that would be in use at the airport. I don't see Chief Smith so. 00:10:07
For our vehicle at the airport. 00:10:18
On page 16, you'll be authorizing disbursement from District 3 improvement funds for the Northridge High School. This is a total 00:10:20
of $7375 and came from Finance Committee last week. On page 17, you'll be authorizing a renewal of the city's helicopter insurance 00:10:26
coverage with Westchester Fire Insurance Company. This is an annual rate of $51,491.00 and came from Insurance and Litigation 00:10:32
Committee last week. 00:10:38
On pages 18 and 19, you'll be tentatively awarding a public works contract to KNA Builders for the City Hall NX1 elevated parking 00:10:45
lot resurfacing project that has a total of $199,000 and came from projects last week. 00:10:52
On page 20, you'll be authorizing a professional services contract with Porter Higginbotham Engineering. This is a total not to 00:11:00
exceed $53,535 and again came from projects last week. 00:11:07
On page 21 you'll be authorizing amount of public works. Contract with Hydra. Service is a total of $7370.59. Again, this came out 00:11:14
of projects last week. 00:11:20
On page 22, you'll be authorizing minor Public Works contract track with Rick's service Company. This is a total of $8500 and 00:11:26
again came from projects last week. 00:11:31
On page 23, you'll be authorizing a minor public works contract with Tusco Inc. This is a total of $36,959.18 and again came from 00:11:38
projects last week. 00:11:43
On page 24, you'll be authorizing a minor public works contract with J&L Tree Service for as needed. Tree Services is a total not 00:11:49
to exceed $50,000 and again came from Projects last week. Skipping over the couple of item and a couple of items that you'd 00:11:58
covered for you, the last thing on on my enforcement agenda on page 33 you'll be setting December 5th is the date for public 00:12:06
hearing to consider the school's request for a property tax increase. If you haven't seen it this morning, I sent each of you a. 00:12:15
Draft of what that public notice will will, I believe, look like We've done some. We've done some tweaking on it. But this 00:12:23
resolution tonight is simply setting the public hearing for the December 5th. It takes no action other than setting that public 00:12:29
hearing. 00:12:34
So when we renamed the streets recently, we caught some. 00:12:40
From people saying they were not aware that there was a public hearing. 00:12:44
How are we making this known out there? We follow the procedure set by state code of, which requires a running in the Tuscaloosa 00:12:49
news. 00:12:54
Is that it? 00:13:03
Typically, we do what we we just follow the state law on public hearings and notice. 00:13:04
OK. I didn't know if because there had been complaints about the typical way not working. Well, if we had considered anything 00:13:10
else. Skyrider. No, Sir. I mean you, you, you will recall on the legislative agenda last year. We've actually sought to kind of 00:13:16
have. 00:13:22
Have some of those requirements change because quite frankly there are better ways to do it than the way we're required to by law, 00:13:29
we have. And actually his team throughout her career has followed several different ways, several different versions as set out by 00:13:35
law. And I can assure you there's definitely no perfect way of doing it that I believe if there's, if there's, if I was just 00:13:41
fishing for a better way, not a perfect way. 00:13:47
Yes, Sir. We do have one item for executive session. I don't remember if Mayor Maddox covered that. 00:13:58
All righty. 00:14:05
Let's see, I want to. 00:14:08
Mayor Maddox for You know, this has been. 00:14:11
It Evan flows something, I said. It'll be gone, gone tomorrow. Then there'll be something new. But I don't know about you guys, 00:14:17
but I have spent, probably since the press release was sent out by the library. I have spent the majority of my time. 00:14:24
Responding but only only to like. 00:14:32
Neighborhood groups or you know, big, big groups because you. But I really appreciate mayor, you've got, you've responded in an 00:14:37
amazing way. I want to echo that in all to everybody. 00:14:43
And and I I took it. 00:14:49
And I pretty good because. 00:14:52
15 minutes. 00:14:54
To. 00:14:56
21 last night and I was because. 00:14:58
For the most part. 00:15:02
People what? Well. 00:15:05
The sad thing? 00:15:07
And I'm going to be very. 00:15:09
The sad thing about a press release? 00:15:12
He goes straight to social media and. 00:15:16
People start posting things that just simply aren't. 00:15:20
You know, I had several things posted about me that I that I had served on the library board, that I was on the Finance Committee 00:15:25
and forced them to come. All those. There were just so many things that just weren't true. 00:15:30
And so that's what you get with that. So that's why I took. 00:15:37
Hours to paint to very carefully respond to the most part, but not on your level. 00:15:41
But I think that's very important because I told someone I said, you know, I don't dodge, you know, I got shamed bad one post 00:15:48
yesterday. I mean I haven't been shamed that much since first grade, but but in the end. 00:15:56
Just about everybody on that page said, Well, you know. 00:16:05
That's not how I thought it was. 00:16:09
So, but I will say. 00:16:11
That I think we all care very much about the library and. 00:16:13
Mr. Crow and I have been asked to. 00:16:22
With the county in Northport. 00:16:25
Next week in it. 00:16:28
Friday Wait. 00:16:32
You know, they were talking about maybe looking at a different financial model altogether, kind of like we did with the Metro 00:16:35
animal shelter. I don't know if that. 00:16:39
Will work. Would be something that are. 00:16:43
But. 00:16:46
I just for everybody out there for you Council. 00:16:47
Counselors as well. Just let everybody know. 00:16:49
That we're going to. 00:16:53
We're not going to have any knee jerk reactions, I think. 00:16:55
Take a due diligence. 00:16:59
Have hopefully it's a very productive meetings with our financial partners and. 00:17:01
Because you guys, I'm sorry, I will say this. You got a split. 00:17:08
Of directors and oper. 00:17:12
So it's not. 00:17:16
All library against the city. 00:17:18
And against Northport or against the county, it's a split board as well. 00:17:21
And I think very much. 00:17:26
He kept to your point. 00:17:31
This all didn't happen in 15 minutes. 00:17:33
A lot of these problems happen way before any of us were on the. 00:17:37
Going back? 00:17:40
Longer than while being mayor, So I mean, I think. 00:17:42
Fundamental. 00:17:45
That have got to be addressed and part of the issue that I've got with it, to echo your sentiments and everybody's got an opinion 00:17:48
at this table. 00:17:51
The way in the process that this has happened, I don't think it's. 00:17:56
And. 00:18:01
In as press release. 00:18:02
Because we all were trying to get together and have a conversation before, before all that happened. So I mean, I think we all 00:18:04
support the library. I think we all want to see something good happen there. 00:18:09
And I believe we will figure something out, but. 00:18:14
I wouldn't expect it to come out of one meeting. 00:18:16
Yeah, in in one day. Because again, this is not something that just happened. 00:18:20
In this budget and that's just part of that's been disappointing to me and I have said that to. 00:18:24
Board members just kind of the way all that. 00:18:30
Happened. I wish we could have had a little conversation before. 00:18:33
That and and you know we're only into the second. 00:18:36
Of their budget. 00:18:41
If there is a problem. 00:18:43
Why does that need to happen? 00:18:45
In 30 days after the budgets passed, Mr. President, I mean you could you've got plenty of money to be fine. 00:18:47
Pretty good bit. But since I'm sure I'll be getting some great postal social media too, but that's fine with me, I don't. I've 00:18:53
been contacted by some people that want to listen. 00:18:58
And I've been contacted by some people that formed their opinion from the press. 00:19:03
Request that people look at the facts the. 00:19:09
Put out some really good facts. 00:19:13
And. 00:19:16
Again, we all want the library. I do not hate the library. If anybody wants to write that, yeah, and I mean what I feel. And also 00:19:17
we'll get there. We'll get there. I think we will. We're all supportive of the library. Everybody that stabilizes. We spent $3.2 00:19:22
million. 00:19:27
If I recall this budget so that we. 00:19:33
So I don't see how we could be. 00:19:36
I'll see it as not for the library, but I'll stop on this now. But I want all the library employees. 00:19:38
Who are probably watching? 00:19:44
My heavens, I have never ever. 00:19:47
Then. 00:19:52
What I've been accused of as far. 00:19:53
Some some post and here I'm giving legitimacy to Facebook but. 00:19:57
To be an anti raises. 00:20:03
For these employees, I mean that's what that raises to the library employees. I mean, I've been told that, well, you just you just 00:20:06
trying to keep people down and they need the money worse than anybody, you know. 00:20:12
And Lord, have mercy. I've never even come close to being I've been out there. 00:20:19
Opposing raises from the library employees, I mean that that's things like that and then some some of the employees believe that. 00:20:26
I really felt that way. 00:20:34
And I said, You know that. 00:20:36
Anyways, it's all been. 00:20:38
It's all been kind of sad. 00:20:41
I go to the library about weekly. I apparently they don't know who I am. 00:20:44
Maybe it'll stay that way. 00:20:49
They won't want me to come in there anymore, but. 00:20:52
But anyway, I just want everybody to know, and it's including this council's may ask that we have been asked. This didn't come 00:20:55
from me or by the chairman of the library board to. 00:21:00
Meet with the funding to be a part of the funding partners meeting. 00:21:07
So we will do that and then keep everybody. 00:21:13
Posted on him When, when and where? And I understand. Somebody asked me today about a December 18th meeting at the library. 00:21:17
Posted. Apparently it's the next. It's an open board meeting. 00:21:22
Of the library December 18th, because people said, well we'll be we'll we'll pack that meeting. 00:21:28
I'm going. I don't even know about December 18, I mean, but I found out later. 00:21:34
Open meeting at the library. 00:21:39
Merry Christmas anyway, it's been It's been unfortunate, but I wish people would. 00:21:43
Not be so quitting to absolutely think the very very very worse. 00:21:49
But it's human nature. 00:21:56
And I'd I'd say this time, first of all I appreciate this Council because last year during their budget hearing for fiscal 23 00:21:58
which you entertained in 22. 00:22:03
We all said we need to do more for the library and so after that budget was passed, we began working with Jennifer with her 00:22:10
appointment, Miss Pearson her appointment. I know Carly and I had several meetings with her and her team. 00:22:14
And then out of that came the increased funding for Weaver Bolden, which they said would have the net effect of freeing up assets 00:22:20
at the main library. 00:22:24
Plus as part of the Weaver Bolden agreement, we put in there contractually that we would pay for any cost overruns. So that was 00:22:29
the first time the library ever had that. In addition, this council led the initiative on the capital improvements as well. Now 00:22:35
all that got approved, approved sometime late spring, early summer. 00:22:41
And that was real progress and I think that's something we should be proud of. The county has done a lot. 00:22:48
And and you've seen it in a few of my emails, frankly, the. 00:22:55
Investment into our library systems, probably. 00:22:59
The model. 00:23:02
I would suspect and. 00:23:04
And North Port, to their credit, has really increased funding. 00:23:06
And and was on a good trajectory. 00:23:09
It's it's UNF. 00:23:13
That the sequence of events felt like they did. But we all know the library is important, and I know that in all of our 00:23:15
discussions in the past week, we're going to keep that first and foremost. 00:23:19
Moving forward, certainly as you said, not about the employees at. 00:23:24
It's just the optics and imagery. 00:23:29
You can't, on one hand, appropriate large pay increases. 00:23:34
And then on the other cut services, especially the services that are not personnel driven. 00:23:38
I think understanding that and acknowledging. 00:23:45
On a road to accountability and transparency in the long run will be a good thing. And Mr. Tyler and Mr. Crow, we can do anything 00:23:48
to give you information as a team. 00:23:53
Going into those discussions, please let us know. 00:23:58
Absolutely. Sure Will. And and again it's that's very important that everybody knows. You know my response from now on from this 00:24:00
day forward and somebody starts back which they did this morning is. 00:24:06
We I'm not gonna. I'm not. 00:24:12
Debate you on Facebook. 00:24:14
We're. 00:24:16
I told you what we're doing the next step. 00:24:17
Not gonna look back, we're gonna look forward and so if you want to get a roll out of me, you're not gonna get it. 00:24:21
This accomplishes nothing, as we all know. 00:24:29
I was shamed. I have never. I have not been that shamed. I can still see my daddy with his stick. 00:24:35
Do you want to talk about that? But I felt ashamed because he did it in front of all my friends. Do you want to talk about that 00:24:45
first grade change? I'll never forget how my dad beat the crap out of me in front of all my friends. 00:24:50
I never got to that level. It was not good. My dad didn't. He didn't. My dad didn't whip, he peed. 00:24:57
But I remember the last one. I never got another one. But you're still here. 00:25:04
Think about it often. 00:25:09
I only took that one time. I never got another one. 00:25:11
Not for that. 00:25:16
I got older. I got a guy out and. 00:25:18
All right, Wednesday we got historic preservation. 00:25:23
Commission meeting and I couldn't do that now. 00:25:28
City Hall will be closed on Friday. 00:25:32
Police and pension board meeting Monday. 00:25:37
OK, no council committee meetings next week. Do the veteran's day holiday or two weeks after that because of Thanksgiving? 00:25:41
And planning, zoning. 00:25:49
Monday, November the 20th, OK. And we have a motion to go into executive session. 00:25:51
Motion second, Mr. Holmes, Yes Sir, is your city attorney and attorney license to practice law in the state of Alabama? I can 00:25:58
certify that this executive session is discussed with their attorney to legal ramifications of and legal options for pending 00:26:03
litigation controversies not yet being litigated, but eminently likely to be litigated if we're imminently likely to be litigated 00:26:07
if the governmental body pursues proposed course of action. 00:26:12
OK. All right. That motion 2nd to go to executive session, all in favor, say aye, any opposed? 00:26:19
