Welcome to the. 00:00:00
Break Council meeting, May 23rd, 2020. Threes good to see everybody. 00:00:00
Of course, Councillor Crow will not be here today. He is. 00:00:06
Having a good time in London last time I talked to him two days ago. 00:00:10
Having a great time. 00:00:17
And I haven't heard from Raven, but I'm sure she'll be here. Matthew, you're gonna be in charge of projects today? Yes, Sir. And. 00:00:19
Matthew is getting ready to head out to Africa. 00:00:27
Saturday morning. 00:00:30
Got all my stuff. 00:00:32
Got your password? Got your visa? You're taking 456? 00:00:35
I'm taking at least two. Ohh man, come on. 00:00:40
You gotta take some pills and he comes right up. 00:00:44
That spells us all the stuff you're gonna get right? 00:00:49
You'll have a great time. 00:00:54
Ohh yeah. And I appreciate you representing very education, honor, and a privilege to represent our city and. 00:00:55
All the things that we do in Tuscaloosa. 00:01:02
Different country. Yeah, Looking forward to it. Absolutely. 10 days, 12 days. 12 days. Yes, Sir. 00:01:05
That's wonderful. 00:01:11
Ohh yeah. 00:01:12
Quite a trip, Quite a trip. OK. Is there a motion that we approve the minutes? 00:01:14
Motion second. All vote say aye. Aye. Minutes approved. OK, Mr. Mills, you're up first today. 00:01:21
Good afternoon, Mayor and council. Good afternoon. 00:01:34
I have one tonight. It's. 00:01:37
Black Warrior LLC DBA grandstand Applause for allowance, Retail liquor However, Octa has some concerns that we need to address 00:01:40
first. 00:01:44
Before we could proceed. 00:01:48
This we would ask that we table this until June the 6th. If you will look down towards the bottom of your agenda, you'll notice. 00:01:50
That you are setting a public hearing. 00:01:56
For the conditional use of this property as a bar slash Tavern. 00:01:59
We can't approve a lounge liquor license yet at that location. 00:02:05
Until a conditional use has been approved, this would this would be like approving a lounge license and a spot that wasn't legally 00:02:10
allowed to have a lounge zoned. 00:02:15
So those will need to be heard in the same meeting or the conditional use heard. 00:02:20
1st. 00:02:24
So we're tabling for how long until June the 6th, which is when the hold on a second date, right? June the 6th? That's when the 00:02:25
the public hearing on the conditional use would be Which one of these? 00:02:30
Black. 00:02:36
It's the old Will Hagens. This is Grandstand, Grandstand, Grandstand. 00:02:37
DBA 00:02:41
Diets to Grandstand. 00:02:43
Just now it was Will Haggen's now grandstand. 00:02:44
It's applying to be blackboard. 00:02:48
No, no, no, Sir. It's Black Warrior Burgers, LLC. 00:02:50
DBA grandstand. 00:02:53
And right now they've got a restaurant license. Yes, Sir, that's correct. 00:02:55
So we want the table for how long until June 6, which would be two weeks 2 weeks. 00:02:59
You may recall they came. I believe they asked for a. 00:03:05
Special condition to be a gastropub that was denied. They have the ability to ask to be a lounge and so they're coming back to ask 00:03:08
to be to be the lounge. 00:03:13
With this, location is currently not zoned for middle class. We know location is zoned to permit a lounge at this point without a 00:03:20
special condition of a bar lounge. Tavern is always a special condition now. 00:03:26
We changed that a year ish ago. 00:03:33
OK. 00:03:42
Is that all? Yeah. Yes, Sir. OK, What about the? 00:03:44
In Overland Park View. 00:03:48
In my district, the one that wanted to expand a drug so they're they're approved for alcohol license they want to use. 00:03:50
The porch area just for seating, seated area. 00:03:58
And so they were already approved, huh? Since they were already approved for the alcohol licensing as the inside. 00:04:03
Then when I say suspend their license premises just to the outside part of it, where is it? 00:04:10
It's not only, but it's it's out on the outside of the building itself. 00:04:15
What? 00:04:20
Where is that? 00:04:21
Approval in the process. So what we did was on this one we. 00:04:24
We've approved a previous business like that in the past. 00:04:29
Which this time we we tried to do the same way we're allowing. 00:04:32
Yourself and council president to actually just sign up on the letter and saying it's OK. 00:04:36
To allow them to expand out to what? You and I talked about this in the hallway a week or two ago, right? Yeah. You, you said you 00:04:41
want to discuss with council members, yes. 00:04:45
So you wanted to discuss with your council members, did not say for me to bring it forward, but you said you were going to talk? 00:04:50
You're saying you gonna talk to him? That not necessary for me to bring it back for you. OK. That's what you understood? Yes, Sir. 00:04:56
Alright, so. 00:04:59
I would, and for the other council members this is. 00:05:02
This is an expanded. 00:05:06
Use of area on a bar in my district. 00:05:10
It they're they're a good district citizen I got no problems with. 00:05:13
And in the past. 00:05:18
Anthony was saying we have handled that with a letter from the district Councilman. 00:05:20
Urgent. In fact, there's an example from you. I don't have any problem with that, but given the sensitivity. 00:05:26
Of the bar situation? I had asked. 00:05:33
And. 00:05:35
Perhaps not clearly. 00:05:36
I wanted that to come back so that the whole council got to see it. 00:05:38
At night, off on it. I don't object to it. I don't plan to oppose it. 00:05:42
But given the sensitivity of what we've got going on with the bars. 00:05:46
I wanted everybody to see that they are, though. Yes, they've already been serving Outback. 00:05:51
They're not supposed to, not in the new location, but if they have an old location, yeah, they were outside. Yes, Sir. Yeah, 00:05:58
that's right. They did have another location across the street. So again, good. 00:06:03
Good citizen plan to support it, but given the sensitivity. 00:06:09
I'd like us all to see that and nod on it. 00:06:12
In an action. 00:06:16
At the Council level, because we discovered, I think. 00:06:17
Where is. 00:06:21
Unbeknownst to me, I didn't realize that existing license. 00:06:23
Bars. 00:06:29
Can in fact expand their facilities without our approval, is that correct? No, no longer. We're no longer. So I I view this. 00:06:30
As an expansion. 00:06:39
Of. 00:06:41
The serving crowd. 00:06:41
Fully planned to support it, but I want the Council to see it. 00:06:44
And have the chance to go yes or no. 00:06:47
OK, I'll reach out to them, let them start their process with it. Alright. That's kind of what we did. Catch a taste. Yes, Sir. 00:06:49
Mr. Myers, will you go back to the grandstand? 00:06:55
OK. 00:06:58
That's in in my district. 00:07:01
Can you kind of refresh what's happening here again? OK, so Grandstand was previously approved for restaurant retail liquor. 00:07:02
They came back before council to get approved for a gastropub, which was denied. 00:07:09
Now that they saying that that since it was denied for the business, they want to. 00:07:14
They want to apply for a lounge retail liquor license. 00:07:18
So. 00:07:21
With with the same specs of the building. No increase of social change in the same specs, OK. 00:07:22
I just wanted to make sure. 00:07:27
OK. 00:07:29
The the effect of the change would be to to occupancy based upon the layout of a restaurant versus a lounge. 00:07:31
OK. 00:07:39
So. 00:07:40
Might be. 00:07:41
Getting they can have more food. 00:07:44
Set up as a lounge, they would not be restricted to a restaurant occupancy, which is which is where we are. 00:07:47
Now. Umm, so how much more? 00:07:55
I think, I don't know what it is now, but it goes up quite substantially. We have the number from the Fire Marshall family, It's 00:07:59
375. 00:08:03
So go up and there are a restaurant with an attached bar. 00:08:07
It would. It wouldn't go up in the footprint. 00:08:11
Didn't change the layout so. 00:08:13
Yeah. 00:08:16
Any more questions, Mr. Mills? 00:08:18
Thank you, Tony. 00:08:21
Appreciate it. 00:08:22
Very, very good. 00:08:24
The support was in there. 00:08:26
Just 6%. 00:08:30
Good afternoon. We got two for you tonight, 3008 20th St. 00:08:33
This house, the owners have been notified, there were. 00:08:38
If we tear it down, the cost will come back to them. They do not choose to. 00:08:43
Fight this. 00:08:48
I believe so, yes. 00:08:55
20th St. 00:08:58
Could you say that again? I'm sorry. 00:09:04
They're not gonna fight. It's. 00:09:06
The. 00:09:09
The owners. 00:09:09
I've been watching this house for quite a while. 00:09:10
And there was people living in it. 00:09:13
Um. 00:09:15
Wow. 00:09:15
Yeah. 00:09:16
And so I never saw the back of it. I couldn't see the backup from the road. 00:09:17
But then the owners were killed. So about a week after that happened, I went and just walked around and. 00:09:22
Lo and behold, the whole backside of the house is falling in so. 00:09:30
Right. 00:09:34
You know, always there was something we could do to help people. 00:09:35
Or get them in the frame of mind when they see that their homes are deteriorating. 00:09:39
Trying to seek some type of help. 00:09:44
Restorative help me, they can't afford it or. 00:09:47
Some means where? 00:09:50
Great opportunities to help them. 00:09:52
What's the address? 00:09:55
3008 20th St. 00:09:57
This this person's niece said she'd been in the house and didn't realize hold back side of the house and fell in. 00:10:02
I can't believe it. 00:10:08
It might be in so much stuff right now, so you never know, yeah. 00:10:10
We're hoping to get. 00:10:16
You know, we're trying to get some kind of wording so we can get. 00:10:18
Move forward on. 00:10:22
Condemning some of these houses with people living in because we've got several in. 00:10:24
In our. 00:10:28
In a couple of the districts that have people living in it that. 00:10:29
Really need to be convened. 00:10:32
They're outside. 00:10:34
They're very unsafe, yes. 00:10:35
I'm afraid, I I'm, I'm literally afraid that they could possibly. 00:10:37
You know, falling around them. We've talked to the people and. 00:10:40
We don't have any help. They don't have anywhere to go. That's that's the that's the issue. We're up against you right. 00:10:44
Exactly right. 00:10:50
That all you that's that's all that's all in that we got one more OK. 00:10:52
This is 3260 Taylor circle. 00:10:56
We're going to try her out there in a couple of accessory buildings they are not going to. 00:10:59
Contest this either. 00:11:04
They are aware that if it's condemned and. 00:11:08
The cost will be back to them. That's in Mr. Wilson's district as well. 00:11:11
I wonder how much land is that trailer sitting on? 00:11:20
Maybe 3/4 of an acre, half acre? I'm not sure. 00:11:25
It's a nice lot, actually. I believe it. 00:11:29
Very level. 00:11:33
Umm. 00:11:35
Nice green. 00:11:36
OK. Next question is Virgil. That's all we got. Thank you. Thank very thank you. 00:11:40
Emily. 00:11:45
Good afternoon, council. Good afternoon. 00:11:51
For rhythm and brews. 00:11:55
So this is for the expansion of their premises into the adjacent space at 2310 4th St. which is several acts throwing today. 00:11:57
Here's an aerial view of that. 00:12:06
And this is in Timberton squared, so reminder. 00:12:09
So this is their proposed floor plan, the expansion so you can see the the doors that are going to be added to allow further 00:12:15
access. This is specifically focused upon allowing for. 00:12:21
A better bathroom area for their patrons. 00:12:27
So this is that proposed bathroom area. It's going to expand significantly from what was built in believe the 90s is what they 00:12:31
told me. It's very outdated with how it is today. So they want to offer something that's a little bit nicer to their patrons and 00:12:38
then this is the proposed area of expansion that's just going to be available with some pool tables. 00:12:44
So again, ohh yes Sir. 00:12:51
So their occupancy is going to increase with this expansion from it's currently 240 today, it's going to increase to 265 per fire. 00:12:55
So to increase of 25 people. 00:13:09
Correct. I've I've had the opportunity to. 00:13:11
Meet with them concerning this property and to see the specs of. 00:13:15
Worked. 00:13:20
The new rendering would look like and. 00:13:22
As I've as I've told them one thing that we want to make sure. 00:13:25
That safety is a priority and that we monitor them. 00:13:28
Occupancy and they are willing to do that. So I really want to go on record as saying I I really want us to. 00:13:32
Think about supporting this project. 00:13:39
So the the pool tables are being removed in the restrooms. 00:13:41
So this the grade area. 00:13:44
On the right hand side, that is the current space as it sits today and everything that's in the white is the new area. So that's 00:13:47
where Civil Acts throwing is right now. So the pool table is going to be brand new area and the bathrooms in the rear are also 00:13:53
new. So there's kind of. 00:13:58
Reworking things. 00:14:04
But everything again in the white that is expanding into the silver wax where that wall is with the two doors. 00:14:06
And to the right that's the current area and see the bathrooms in that place would be able. 00:14:13
Would be a more secure place. 00:14:20
For those persons who need to go to the restrooms, currently it is not as secure. 00:14:21
As it will be once they make these unnecessary. 00:14:27
Corrections or additions. 00:14:32
Is the obviously increase required by code because of the suspension or? 00:14:34
Or could. 00:14:41
They could. Do they have? 00:14:44
My my concern is this I I know it'll be a great project. 00:14:46
We have been adamant about. 00:14:49
Not increase in occupancy in areas where we've had crime. 00:14:51
And. 00:14:56
You know incidents of of. 00:14:57
Extreme violence. 00:14:59
And. 00:15:01
I just. 00:15:02
He's been very clear. I've been extremely supportive of PD in that. 00:15:04
So. 00:15:10
Just be interested to know do we have. 00:15:11
To increase the occupancy to do this or we required by our own. 00:15:13
Ordinance is so this is the design I can load that was submitted by the design professional. 00:15:17
This is sort of like the. 00:15:23
The trade off that happens when you expand, you know. 00:15:25
Is the overall is measured by the overall footprint of the building, so. 00:15:28
You know, the code does give the HJ the ability to. 00:15:33
Decrease occupant lows at times you know to. Lot of times people do that for bathroom fixture counts and things like that, but 00:15:37
they cannot decrease to try to. 00:15:41
Circumvent any. 00:15:46
Provisions in the Code that relate to life safety. 00:15:47
If that answers your question, so. 00:15:50
Overall question is do we? 00:15:52
Do we have to increase? 00:15:55
Based on what's approved? 00:15:56
We would but. 00:15:58
They they does have. 00:15:59
An exception in the code that says OK, it can stay marked as 240 if that's what we really want to do. 00:16:01
So. 00:16:08
It's kind of a. 00:16:10
But what do you want to do in the next case? And one concern I had right here was future tenancy. 00:16:12
Like if we did have a fixed OK low here of 240. 00:16:17
And you had a future tenant come in, say, that wanted to put like an event space there for an example. 00:16:21
And they wanted to use just concentrated assembly. 00:16:26
They're actually low. Would naturally go up just based on the type of use, so. 00:16:29
You know, I don't know. 00:16:34
How we would handle that in the future if someone came there with a different business model? 00:16:35
In our low we went up just. 00:16:40
For the sheer fact of what they're doing, they would relate to alcohol what would be required. That's a good what would be 00:16:42
required if somebody if they this was sold. 00:16:46
Would they? They'd obviously have to get a transfer of any alcohol license, and I assume it'd be a different type. 00:16:52
Word. 00:16:58
Dance space. 00:17:00
How about any other planning requirements that would? 00:17:01
Would make this have to come back to the Council. 00:17:04
Not so. The conditional use process is specifically for bars, Taverns, gastropubs. It wouldn't be for an event space. 00:17:07
So that wouldn't be something that would have to come back. I know that we had discussed with a previous application that came 00:17:15
through a conditional use application about whether council would want to put a limitation, like council putting that limitation 00:17:21
on the number of occupants and saying if we approve this conditional use, we're going to say that it can't be above 240. So if 00:17:27
someone else came in, that conditional use would go away and so would that condition of the occupancy. 00:17:34
That was, I mean, we talked about that, but that was never something that ended up actually moving forward to council. 00:17:40
Ohh, we don't have to approve an alcohol. 00:17:47
For any new use. 00:17:50
Completely. 00:17:54
Yes, Sir. 00:17:56
You actually do. 00:17:57
I do. 00:17:58
Europe. 00:18:00
This 44. 00:18:01
This is actually a change of use a change of space. Additional use so. 00:18:04
The license was approved for the old location. I'm not talking about for what's. 00:18:08
Before us. Now I'm talking about. 00:18:13
In regard to the question that if. 00:18:16
If we decide. 00:18:19
OK, we understand what they want and we'll. 00:18:21
We'll approve it if they'll. 00:18:25
I believe you said. 00:18:27
You could maintain the marked capacity. 00:18:29
Of 240. 00:18:32
Did you? 00:18:34
But the issue was what happens. 00:18:35
Down the road, if it sells changes, we don't have to approve that. 00:18:38
You wouldn't have to prove it, I think it's just. 00:18:44
The main question is coming get the party spoiler. You understand what I'm saying? I'm not talking about with regard to what's 00:18:46
before us now. OK, so if I'm understanding your question right if the new new person comes in with the. 00:18:53
Added. 00:19:00
Co occupancy level and they'll climb based off the added occupancy. You're proven based off the new specs or occupancy level. 00:19:01
Come from that way, not this right here, but if you call came in to me. 00:19:07
And. 00:19:12
Mr. Fell had this location. 00:19:12
And he turned around and you saw and he saw that you bought purchase it. 00:19:14
Would allow lounge based off the added space. 00:19:17
Then you would have to buy your liquor license based off the added increase. 00:19:21
But the council doesn't have to approve that literally. But you gonna be denying it. The whole, like some of the confusion is, is 00:19:26
terminology. 00:19:30
You're saying have two is in doesn't have a choice. It would have to come before council. But you could vote no I I think that's. 00:19:34
I think that may be some of. Yeah. OK. I I see what you're you know it's like. 00:19:40
Any change of ownership or change of usage comes to us. 00:19:46
And we can say yes or no. 00:19:50
Hmm. 00:19:52
So since we want to decide whether we want to do 240 or 265. 00:19:54
I'm assuming the mayors. 00:20:00
Tom yet again is kind of. 00:20:02
Connected to what I was talking about was. 00:20:05
Given the sensitivity. 00:20:07
Of of not only. 00:20:09
Occupancy, but in this particular case. 00:20:13
The volatility. 00:20:18
Of that general area. 00:20:20
I. 00:20:22
I'm assuming you brought that up. 00:20:22
To make that potentially more palatable to those of us. 00:20:25
That have concerns about that. 00:20:28
Well, I'm. I know that Chief Blankley, who's out of town today, couldn't be here. 00:20:30
Him and I've discussed this and. 00:20:35
You know, he feels very strongly that we're. 00:20:37
We're at a difficult point right now because as you know, and we're 30 plus officers short. 00:20:41
We are. We have a lot of demands in our entertainment areas that are quite frankly taking away from other parts of our city. 00:20:47
We want to reduce any long term liability of that now and into the future. 00:20:56
If we open up. 00:21:00
If we expand the occupancy on this. 00:21:02
And then you know 25 we're increasing then you know it just. 00:21:05
It reverses what we've been trying to do for the last several months. Again, I. 00:21:10
You know the the project seem has merit and and certainly you won't nice clean facilities it it would. 00:21:15
But it wouldn't. You know one thing, it would make this permanently a bar. 00:21:22
I mean, there's no chance and I don't know if that other space, because it could be something else. It it may can only be about, 00:21:26
it may only be big enough to only do something. 00:21:31
Being asked which we know the market probably within maybe, I don't know, maybe didn't support. 00:21:37
But. 00:21:44
I know that when the police chief. 00:21:45
Comes to me with that type of conviction. 00:21:48
And that's the way he feels. I'm going to certainly support him in that because. 00:21:51
You see every day when we send you these significant events what we're up against. 00:21:56
And in many of our own inner, what I call entertainment areas, timber, some strip. 00:22:02
Again. 00:22:08
This would be counter to the things we've been doing. 00:22:09
You know, and then told him about. 00:22:13
So you know one way I thought, maybe we could. 00:22:15
Solving it was to. 00:22:18
Not increase the occupancy. 00:22:21
So you're keeping the status quo with better facilities, but that may not be. Again, I'm saying this, we haven't heard from the 00:22:23
petitioner. That may be something that's not doable. 00:22:27
So. 00:22:32
Chief floor. 00:22:34
I'm just gonna go with the mayor said exactly what I was here to say. 00:22:36
When we're dealing with the entertainment districts, the larger the, the. 00:22:41
More app. We ought to have those problems here you're taking away and being used. It would be operating maybe 60 or 65, another 00:22:45
time of the day. 00:22:50
So yeah, it's less people overall, but it's it's different uses, different times of the day. It's an on alcohol use for the most 00:22:55
part you're just increasing the size to another. 00:22:59
So just being able to from from our perspective as public safety perspective in the area which is in I, I don't we can't support 00:23:06
for what we do when we look at we can support them. 00:23:11
So I got a question per. 00:23:19
The fire marshals. 00:23:23
Comments based on the size of the building. 00:23:27
Volume. 00:23:31
Space. 00:23:33
If that space was already used, like if I could, this is my volume. 00:23:36
And. 00:23:41
And I only use 1/4 of this building. 00:23:42
And about open it up. 00:23:46
All the way. 00:23:47
Does that not? 00:23:49
Will it not increase? 00:23:53
And I and I understand totally what you're saying, Mr. Mayor. 00:23:55
Does not it increase my space that I have to be used? 00:23:59
And if so. 00:24:04
How do I? 00:24:05
How do I? 00:24:09
Deal with that on a level. 00:24:12
Where it would not seem to be hindering the business of those. 00:24:14
Who have now expanded their building and have the space to do so. 00:24:19
So I guess what I'm saying is. 00:24:32
That that there's previous space that they had. 00:24:34
Is eligible to have 265. 00:24:38
And they're due to 65. How can we legally or do this and not hinder? 00:24:41
The the progress of the bar fit. The bar is due 265 but we want to cut it because. 00:24:45
Safety measures, I mean, if the bars do that. 00:24:51
Are they legally? 00:24:54
If you come here I I think that special can be can be had with with the owner and special consideration can be put in place for 00:24:56
this particular occupancy. 00:25:01
To cover the and address that and if they're good with and we're good with it, we all sign off on it and just move on. I just want 00:25:06
to be careful with. 00:25:10
Creating exceptions that create confusion down the road. So people. 00:25:14
Don't want to come in and try to manipulate oculos just to circumvent our already rules that we have in place. So I just want to 00:25:18
be careful about that. Yeah, that makes sense, makes sense. So. 00:25:23
The renovations are necessary, it seems like. Well, what's the increase in occupancy? 00:25:29
Was that a major concern or request from the petitioner? I know it's just 25 people, but I'm just trying to follow their process. 00:25:34
So when I spoke with the design professional. 00:25:38
He. 00:25:46
He even made it seem to me that. 00:25:46
The the anchorage, the bathrooms room. The most important thing. 00:25:49
It wasn't an increase in occupant mode, so that's the vibe that I got from the design professional. 00:25:52
OK. 00:25:57
And in terms of. 00:25:58
25 people doesn't sound like a lot. 00:26:00
And again, Chief Clark, correct me if I'm wrong. 00:26:03
We have an area that. 00:26:08
D already believes is too intense. 00:26:09
On Thursday, Friday and Saturday nights, he creates a problem. 00:26:13
Now we're we're where you have a daytime use. 00:26:17
Now that 25 is going to become. 00:26:21
A night time use. 00:26:24
Gotcha. So you're you just added that additional burden and again? 00:26:25
We already have an area that right now we have flagged. 00:26:31
We're putting a lot of resources in along with the strip. 00:26:34
And one of the things you always communicate to me is you should is you want more TPD resources in your districts. I don't have 00:26:38
any. 00:26:42
So you would like some you would like, yeah just one placement would be nice on the east side of town and right now with 30 00:26:47
vacancies. 00:26:51
And how many 15 in the cash or something like that? 00:26:57
You do that. 00:27:02
You got that? 00:27:07
I saw ten last Well, there's 27 people. Yeah, right. Right. Now I think 27 if I counted right. 00:27:08
That doesn't seem like a crowd unless. 00:27:15
Skip. 00:27:18
Ask them to leave and they won't. 00:27:19
You know, I mean, if they don't do what you say, then 27 people's a lot of folks, Gee. 00:27:21
Ohh Chief Clark. 00:27:28
The. 00:27:29
The area is already traffic wise for the for the use time. 00:27:31
With the number of licenses, establishments that are in that area and the number of people those crowds, yeah there's some coming 00:27:34
and going, but it is, it is a one time flushing and flush out. 00:27:39
You have high congested traffic and everything else like that. 00:27:44
And then plus just the nature of. 00:27:48
Everybody leaving the bar at the same time, 20-5 people, does. 00:27:50
Generally make a difference. 00:27:53
I mean if we, if we keep expanding those areas out that are so concentrated now in Timberton and the strip area and they keep 00:27:55
expanding. 00:27:59
Individually, we're going to need an just going to need a Police Department just to know itself. 00:28:03
Handle those areas and I'm very serious. I get calls here and you know it. 00:28:07
You don't have any police officers. 00:28:14
On the weekends on the east side of town. Correct me if I'm wrong, it's not time it can get, Kind of. 00:28:16
Because the phone calls I get is. 00:28:22
And what in the? 00:28:26
Again and I know. 00:28:27
And just so the public understands what we're up against. 00:28:29
Is not only just, you know. 00:28:32
Trying to identify the best officers possible for work in today's environment is difficult, That's true, but our competition in 00:28:34
North Port and the county used the fact that they don't have any. 00:28:39
Entertainment districts where officers are required to do mandatory overtime 1:50. 00:28:46
Or 10:00 to 3:00 on Friday, Saturday. 00:28:52
Thursday, Friday and Saturday nights. 00:28:55
They they use that against us because today's police officers are more apt to want more time off and less overtime. 00:28:58
And the more issues we create ourselves, the more difficult it is for Chief Likely and Chief Clark and Chief Sanders. 00:29:06
And Chief Rice to go out and recruit and us retain. 00:29:15
Those police officers and. 00:29:19
We just, you know, we feel strongly that. 00:29:22
You are the policymaking body of the council. We don't have a vote in this. We want you to be aware of. 00:29:25
You know the impacts of this and we certainly would. 00:29:33
Prefer not to add more to an area that already is creating. 00:29:36
Some issues just because of the number of of bars, number of alcohol establishments in in that particular geographical zone. 00:29:42
We we've got, we've got a. 00:29:50
Couple executive sessions items and. 00:29:54
We need to move on. This will be a public hearing tonight. 00:29:57
Well, yes, Sir. You'll be real brief because we got a public hearing tonight for you to speak. I'm one of the owners of Timbers 00:30:01
inspired. Yeah, yeah. Roger, you come up, speak up here at the mic. 00:30:05
This all started. 00:30:19
A few months ago, where we was trying to call Taylor was trying to purchase a building permit. 00:30:20
Because the actual and facility. 00:30:26
It's struggling. 00:30:29
And all their facilities are struggling. So I think that's sort of. 00:30:30
Our faith is gone, gone away. So they wanted. 00:30:33
To release it back to us as level. 00:30:36
Redmond Brothers, which is also. 00:30:40
A landlord and the owner of Rhythm and Brews, which is just. 00:30:42
Randy White. Jeremy White. 00:30:46
They said, well, we'll just take it because our restroom facilities are in bad need. 00:30:49
Said OK, well as landlords if y'all would do that. 00:30:54
We will sprinkle the bill. 00:30:57
Nobody's mentioning that here today. 00:31:00
This is how we structure and I promise you if it went on, if it started a fire there today. 00:31:02
Fire department. I probably can't put it out because it's all lighter pack. 00:31:08
So, so all these spaces that we've been. 00:31:12
Renovating them and improving them. 00:31:15
We have put the sprinklers in which we're going to do these two facilities here. 00:31:18
Rhythmic brews and the actual facility. 00:31:22
Whenever this is approved now. 00:31:25
We've never asked for an increase in. I see. I don't know where it came from. 00:31:27
Because that's a big deal. 00:31:32
But we really need a permit. 00:31:34
Where we can get this thing built and moved on. 00:31:36
For two months, that's right. 00:31:39
In a normal situation two months ago, this thing would have been permitted, we would have been. 00:31:41
Had a minute by minute. 00:31:47
You can just keeps. 00:31:48
They can't get pushed out. I know we need to move from understanding you correctly and why it's well. 00:31:50
The 2:40 just fine. 00:31:57
We've never asked for anything. 00:31:59
That came about in the design because of the increase in space and the fact that we're sprinkling. 00:32:02
The bill. 00:32:08
So if if that's what it takes, then let's get it done. 00:32:10
Absolutely. We'll be fine with that. We've been there for 22 years at that, at that number. So hopefully we're there for another 00:32:16
20. Does that come from? 00:32:20
It's probably just because because the the the updated drawings and and added facility we we our women's restroom areas right now 00:32:25
we have 3 units. 00:32:30
And. 00:32:34
You know and those things get back to and we're looking for a better customer experiences we're looking for. 00:32:36
Problem. 00:32:42
Right. And we actually got a, a temporary facility sitting out in the backyard. 00:32:43
For for the women to get to eat. Roger, how long have you? I didn't know you. How long have you owned this? 00:32:49
Gosh, I don't know. 10 years? Pretty good. Wow. Good. 00:32:55
But the sprinklers? The sprinkler systems? 00:33:00
And the fire alarm? 00:33:02
And panic devices on on every one of those exits right there. 00:33:04
That those are all those are all new additions also that's going to go right along with this. So we want to go ahead and do that. 00:33:09
Because partners in the property too. So, so would it be OK for us to go ahead on and keep it at the 2:40 and move along and we do 00:33:17
that? 00:33:20
So they are, as long we'll probably don't know what it is. 00:33:25
I know you hate when we say what it will take legally, but if I'm if I'm reading the room correctly I'll have my office prepare 00:33:28
substitute tonight that states 240 is the occupancy. And also just FYI the alcohol license sort of component of this will be in 00:33:34
front of y'all on on the 6th. 00:33:40
Thank you Mr. Holmes on the 6th, 6th June. 00:33:46
And it just just to make certain I'm clear, any change of ownership in the future would require that license? 00:33:50
To come back, either a transfer of ownership if someone was continuing the use of a bar Tavern. If somebody wanted to reopen as a 00:33:56
restaurant Event Center, they'd have to come back and make an application for a new alcohol license that. 00:34:03
OK. Thank you. Thank you, Roger. Thank you. Appreciate you. 00:34:10
Alright. 00:34:17
Paramedics. 00:34:18
We. 00:34:21
We're long. 00:34:22
That's OK. 00:34:24
We, you know, we've only got 3 committee meetings, that's agenda free. 00:34:25
OK. Yes, Sir, Mr. Holmes. Thank you, Scott. Roger. 00:34:32

On page 25, you'll be acknowledging the contents of the 2022 municipal water pollution. 00:36:45

On page 26, you'll be authorizing the mayor to execute utility easements with Alabama Power Company regarding the Western 00:36:59

You'll be authorizing a contract with the American Registry for Internet Numbers Limited. 00:37:11
That was again in projects last week. 00:37:16

That came from Finance Committee last week. 00:37:57

As the date for a hearing to consider approval of conditional use for Black Warrior Burgers. 00:38:07

And on pages 33 and 34, you'll be setting June 13th as the date for hearing to consider approval of North Village Subdivision, a 00:38:33
planned unit development. 00:38:38
Any questions for me? 00:38:43
Questions for Scott. 00:38:45
Thank you. Thank you, Sir. 00:38:47
All right, we've got. 00:38:49
Projects 230 Finance 315 Public Safety at 4. The council meeting person 6 Airport Advisory Committee meets tomorrow at 3:00. 00:38:51
And again, no council or committee meetings next. 00:38:59
Tuesday So. 00:39:03
Will be away for. 00:39:04
Two weeks. I've got 3 little housekeeping notes for the Council I want to congratulate. 00:39:06
Councillor Lanier on your town hall meeting. 00:39:13
I was really pleased to. 00:39:16
You took me back about 20-6 years ago when my first town hall and I felt, I felt, I felt. 00:39:18
Coming in. 00:39:27
I can remember how that first video was. We did a great job. 00:39:28
Staff did a great job. Nice turned out. 00:39:32
I saw someone yesterday who said I saw you cash just down home meeting. 00:39:35
It was really great and you had so well organized that everybody's concerns was written down and. 00:39:39
I'm sure you probably already been addressed by now. 00:39:44
But. 00:39:47
Really good job, appreciate it. Give it up for the staff, They made me look great. 00:39:48
It was them. 00:39:53
Thanks to all the staff. 00:39:55
For the time to come now. 00:39:58
Yes, Sir. 00:39:59
I was trying to get them and I was trying. 00:40:01
We did. 00:40:05
I want to support you also. 00:40:11
Just a quick reminder if you do want to support the Kindness Croom. 00:40:15
Foundation that. 00:40:18
Ball banquet always coming up $400.00 a ticket. 00:40:20
We can't use district funds for that, but you can't use your campaign funds. 00:40:25
Or your personal funds and. 00:40:29
The deadline is coming up quick on that, so if anybody would. 00:40:31
Like to purchase a? 00:40:35
A seat. 00:40:37
Or two. Or whatever. Or not, but just kind of. 00:40:38
Let me know as soon as possible. 00:40:42
And also if council will get with me on resurfacing. 00:40:45
There was. I was going to respond Ohh. 00:40:49
But I don't know if you've had this problem, I know, Mr. Busby said. 00:40:52
He has some soon as I get her e-mail, sometimes it just vanishes out of my phone. 00:40:55
Before I open it. But when you close it, it's not. Yeah, and it's just not there. I don't know what's going on, but I had some 00:41:01
suggestions but I don't think there's any worries about. 00:41:06
Pretty surfacing that is not a finalist. 00:41:11
Yeah, I found that out. 00:41:15
Right, right. 00:41:19
Ohh yeah there's also has some some suggestions. 00:41:22
Keep that in house if you will get with me because we can do things like. 00:41:28
From this point to that point instead of. 00:41:33
Like instead of me saying I want all Hillsdale. 00:41:35
You have you like broke your road to 10 10th St. you know and because and things like that. But anyway, I'm glad to help in any 00:41:38
way and I feel like I. 00:41:42
Kind of fell down the job with that because I don't think we've really had to. 00:41:47
Resurfacing meetings, especially for the new ones. 00:41:50
I think that. 00:41:53
And and. 00:41:55
And and I suggest if you haven't already, certainly with their and you got a dry ride through. Our district is so large you may 00:41:57
want to do more than one. 00:42:01
So. 00:42:07
Anyway, that's all I had. 00:42:07
Any department heads or any staff have anything to add before we go to executive session? 00:42:11
All right. You'll hear motion to go into executive session. 00:42:18
Motion second, Mr. Holmes, Yes Sir, is your city attorney and an attorney licensed to practice law in the state of Alabama. I can 00:42:22
certify that the topics in for executive session are to discuss with their attorney the legal ramifications of and legal options 00:42:27
for pending litigation. 00:42:32
Comma sorry, I'm reading the wrong 1. Excuse me to discuss security plans, procedures, assessments, measures or systems, or the 00:42:37
security or safety of person, structures, facilities, or other infrastructure, the public disclosures of which could reasonably be 00:42:42
expected to be detrimental to the public safety and welfare. 00:42:47
And to discuss the consideration the governmental body is willing to offer or accept when considering. 00:42:52
The purchase, sale, exchange, or lease, or market value of real property. 00:42:57
OK. 00:43:03
Have motion second going executive session. All in favor say aye Any opposed All right if you're not part of this executive 00:43:04
session. 00:43:07

Roger. 00:34:32

All in favor say aye Any opposed All right if you're not part of this executive 00:43:04
session. 00:43:07
scroll up
